The following defense of the principle of excluding broadcasting from the courtroom is based on California's Rule 980 rather than upon Canon 35 itself. It originally was published as the “President's Message”; in the March-April, 1966, issue of the Journal of the State Bar of California. Mr. John A. Sutro, President of the State Bar at that time, is in private practice in San Francisco. The adoption of this rule, together with the extension of similar prohibitions by the Federal judiciary to include many areas outside the courtroom itself (such as corridors), caused a great deal of agitation among the news media of California. The reader is directed to the Sigma Delta Chi Freedom of Information Committee annual reports for compilations of similar state rulings. |
