Examines the legal context of the professional judgment standard, discusses how treatment decisions have been used to obtain services for children that were otherwise unavailable, and demonstrates how the standard allows mental health professionals to improve conditions in institutions. In Youngberg v. Romeo (1982), the Supreme Court hem that courts must defer to the judgment of mental health professionals in determining what treatment services are constitutionally guaranteed to institutionalized persons. This holding provides child advocates and mental health professionals with two potential strategies for advocating for institutionalized children: (a) order appropriate but currently unavailable services and (b) raise current professional standards for conditions at institutions. |
