Techno-economic pressures have stimulated a dynamic of regulatory competition in the “communication” sectors, involving a paradigmatic change of regulatory policy from state monopoly to a liberal, pro-competitive regulatory order. To achieve a harmonized European response, the European Union (EU) has deployed policy transfer and learning mechanisms, ranging from coercive to voluntary. However, positive integration (market-correcting, re-regulatory) requiring intergovernmental agreement, is more difficult to achieve than negative integration (market-making, de-regulatory). Moreover, regulatory harmonization has proceeded further in the “technocratic” sector of telecommunications than in the “politically sensitive” broadcasting sector, where the promotion of socio-cultural goals has made for continuing national divergence.
