Contents: The EPA's stated willingness to participate in alternative dispute resolution (ADR), coupled with the extraordinary cost and complexity of environmental cases, increasingly motivates litigants to choose alternative dispute resolution as the preferred method to determine responsibility in these cases. A participant's selection of the ADR neutral, method, or settlement strategy can determine the ADR outcome even before the first negotiation session. Inadequate preparation or failure to consider ADR issues unique to environmental cases may preclude successful protection of a party's position at any point in the process. The authors suggest several strategies to help litigants achieve favorable outcomes throughout the ADR process.
