California recently dealt with a version of surrogacy conflict (1). Mark and Crispina Calvert had their fertilized egg placed in Anna Johnson. She agreed to bear their child for a fee of $10,000. Ms. Johnson claims that she bonded with the developing child and that, at the very least, she ought to share parenting of the child. The Calverts claimed that because the baby was theirs genetically, it was theirs and not to be shared. In effect, they were claiming that method of gestation and birth is irrelevant to deciding parental rights. |
