Inhoud: This study dealt with the legal concerns associated with federal antidiscrimination legislation and the increasing reliance on part-time faculty in community colleges. There are serious consequences when policies relative to part-time faculty are inconsistent with these laws. The study also built on the concept of preventive law “through anticipatory administrator behavior.” This requires knowledge of the present policies and practices at an institution and how they may bear on potential legal challenges. The major research question which guided the following inquiry was: What awareness of the intent of affirmative action and civil rights legislation do administrators in Pennsylvania's community colleges demonstrate when regarding the application of these statutes to their part-time faculty? For this question, differences in awareness by administrative level was also analyzed. The major conclusion drawn from the study is that Pennsylvania's community colleges do not appear to show an awareness of the intent of affirmative action considerations in dealing with their part-time faculty. It would seem they are not engaging in a strategy of preventive law when dealing with the part-time segment of their staffs. This would lead to the additional conclusion that a strong potential for legal challenges exists. Further investigation of this issue may be warranted in other regions of the country and other levels of higher education.
