Inhoud: An important case involving the office of Paramount Chief of Basutoland was heard in the High Court of Basutoland in 1943. By permission of the Resident Commissioner we publish below the full text of the judgment delivered by Mr. Justice C. W. H. Lansdown. A good deal of evidence was heard on the question of women's status under Sotho-law and custom. The court found that the people were changing from the idea of the family unit towards a larger appreciation of the rights of the individual. The practice of appointing women to the post of chief, sub-chief, and headman had encouraged the emergence of women from the state of tutelage which applied to them in earlier times. The court held further that the custom of kenela whereby a man can step into his deceased brother's place in relation to the widow in all matters of property and guardianship had declined to such an extent that it was no longer binding upon women. Although there was no precedent for the appointment as Regent of the senior widow of a paramount chief, there had been many cases in which the senior widows of chiefs had been appointed to vacant chieftainships for their minor sons. In the present case the proper procedure had been followed, and the position of the chieftainess was unassailable. The plaintiff in the case was Chief Constantinus Bering Griffith, and the defendant Chieftainess Amelia 'Mantsebo Seeiso Griffith.
