Inhoud: Mitigation testimony in the sentencing phase of capital cases provides the defense with the opportunity to present psychological and psychosocial evidence about the defendant. Previous research has sought to identify the mitigating worth of various psychological and psychosocial factors, but has primarily focused on the value of independent mitigating factors. The present study investigated the affects of periods of childhood abuse on mitigating potential, as well as the affect of increasing the number of mitigating circumstances presented. It was found that increasing the number of psychological disturbances and psycho-social circumstances presented resulted in higher perceptions of mitigating value by mock jurors. In addition, extended periods of childhood abuse suffered by the defendant were associated with an increase in juror compassion. The implications of these results for mitigation experts are discussed.
