Inhoud: While the legal position of lesbian mothers has improved over the past twenty years and some legal battles and human rights protection have been won, there is still a long way to go. This paper explores the acceptability of some policy alternatives within the lesbian community. Some of these alternatives are based on existing law as it has been applied to heterosexual families. For example, a number of the legal arguments have been used to defend the rights of step-parents who are not biological parents and yet have assumed a parenting role. The advantage of using such arguments is that there is already a legal precedent on which to build. The disadvantage is that the traditional family model may not be the model by which we wish to challenge the present legal context. Is equality contingent on equating lesbian families with traditional families, or is equality the acknowledgment and honouring of diversity and difference, with a legal system that is flexible enough to protect this diversity? These questions frame a debate within the lesbian community as well as within the larger polity.
