Contents: Judicial review has dealt with cases involving decision-making in relation to children, and provided a context in which the inter-relationship between the welfare of a child, and the rights and interests of a child, a parent, a local authority and third parties can be considered. The Children Act 1989 also seeks to define the interrelationship between these various interests. The article considers the use of public law controls, the nature of the constraints on local authority decision-making under the Children Act 1989, and considers the impact of the Act on the role of the public law.
