Contents: Continued debate is likely on the issue of whether there should be legislation to introduce a new “Community Treatment Order” (“C.T.O.”), perhaps in the form of an enhanced version of mental health guardianship. Such an order would permit the compulsory administration of drug treatment (in particular anti-psychotic medication) to patients in the community. This article surveys the current state of the relevant law and existing proposals for change, and assesses the arguments for and against the creation of a new order. It is concluded (on the basis of philosophical principle) that the case for the Community Treatment Order is insufficiently strong to justify its introduction.
