Children first? Welfare reports in unmarried parent cases

Title: Children first? Welfare reports in unmarried parent cases
Author: Collins, Rosemary
Macleod, Alison
Appeared in: Journal of social welfare and family law
Paging: Volume 13 (1991) nr. 6 pages 442-453
Year: 1991-11-01
Contents: The Children Act 1989 checklist of matters which are to be considered by the court in reaching decisions about a child is headed by the child's wishes and feelings. This article welcomes this aspect of the Act and explores how far children's attitudes were taken into account in welfare reports in a sample of pre-Act unmarried parent cases. Using data from an ESRC research project on unmarried parents in the matrimonial and domestic courts the report touches on the background to the change in focus and looks at the characteristics of cases referred for report. The subject-matter and recommendations of the reports are reviewed. The article uses case-studies to illustrate discrepancies and variations in the presentation of the reports, inluding those on very young children. The article concludes that all children in cases where reports are required should be seen by the reporting officers and that further training is necessary to assist those who prepare court reports in private law cases to improve their communication and interpretation skills as far as children are concerned.
