Inhoud: The law governing financial provision on divorce has provoked much debate in recent years.1 Dissatisfaction with the idea that the court should try to, “place the parties … in the financial position in which they would have been if the marriage had not broken down”2-3 led to a search for new principles. Lord Scarman's concluding comments in the 1979 Minton decision4 were a catalyst for the acceptance of the “clean break” principle by academic writers5 the Law Commission,6 and Parliament itself with the Matrimonial and Family Proceedings Act 1984. This paper will argue that: (1) The principles expounded by Lord Scarman were descriptive of contemporary law and practice. Many of the ideas had been present for up to 50 years, and needed no legislative changes to bring them into effect. (2) Child-care needs, the impact of child-care responsibilities on labour-market participation, the impact of reduced labour-market participation on earnings potential and pension rights, and the relationship between private and public sources of support are all major economic questions which the 1984 Act does not consider.7 (3) The lack of consideration given to the effect of changes in the formal law on the day-to-day operation of the law means that although section 3 of the 1984 Act makes “the welfare of the child” the first consideration, its effect could well be the opposite.
