This article examines the conventional wisdom that an early legal break with the past is critical for democratic consolidation and finds it to be problematic. The post-communist cases in central east Europe demonstrate that the liberal formula of free and fair elections followed by the ratification of a new constitution is not always desirable and may be sub-optimal when state sovereignty has not recently undergone redefinition. Since both semi-presidential and parliamentarian constitutions have framed stable democracies in the region, the research also indicates that the form a constitution ultimately takes is probably less important than the process that produces it. |
